Terms & Conditions
for Specialists

These Terms & Conditions govern the use of ClearShift by independent Specialists — including photographers, videographers, storytellers, trainers, Google Business specialists, and musicians or DJs. By accepting an introduction from ClearShift, you agree to the terms below.

1. ClearShift’s Role

ClearShift is not a recruitment agency, employer, or staffing platform. ClearShift introduces independent Specialists to hospitality establishments who could benefit from their services. You are not employed by ClearShift — you remain an independent operator, responsible for your own work, invoicing, tax, and business conduct. ClearShift currently operates within the Cape Peninsula.

2. What ClearShift Does

When ClearShift identifies an establishment that could benefit from your services, we make the introduction on your behalf, at no cost to you or the establishment. From that point, the commercial relationship for the work itself is between you and the establishment directly — you agree scope, pricing, and delivery with them, and you invoice them directly.

4. Confidentiality

You may not disclose the existence, amount, or percentage of ClearShift’s commission to any establishment, under any circumstance, and may not reflect it as a separate line item, deduction, or reference of any kind on any invoice or quote sent to an establishment. Establishments are told only that the introduction is at no cost to them.

Breach. If you disclose the existence, amount, or percentage of the commission to an establishment, or reflect it on an invoice, ClearShift may terminate the introduction arrangement with immediate effect, and continue to pursue any commission already owed and any commission ClearShift is unable to collect as a direct result of the breach.

5. Independence

Nothing in these terms creates an employment, partnership, or agency relationship between you and ClearShift. You are free to work with establishments ClearShift has not introduced you to, and to run your business as you see fit, subject to the commission and confidentiality obligations above for introductions ClearShift has made.

6. No Exclusivity

Engagement with ClearShift is non-exclusive. You are free to source work through other channels.

7. Liability

ClearShift is not responsible for the performance or conduct of Specialists once engaged, any disputes arising between the Establishment and a Specialist, or the quality or delivery of work performed. ClearShift’s role is limited to introduction and coordination.

8. Changes to Terms

ClearShift may update these Terms & Conditions from time to time. The latest version will be available on the ClearShift website.

9. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.
